Congress Moves on a National Anti-Scam Strategy to Protect Older Adults

Last month, the AARP, recognizing that the holiday season leading up to Christmas is widely viewed as “prime time” for scams targeting older Americans, released findings from its 2025 Holiday Shopping and Scams Survey. According to the AARP Fraud Watch Network, fraud aimed at online shoppers and holiday donors continues to skyrocket.

With Christmas fast approaching, millions of Americans are preparing to shop and give online. The Survey, released just nine days before Thanksgiving, reveals that a majority of U.S. adults (89%) have encountered at least one scam. These include fake notifications about shipment issues (55%), phony charity appeals (35%), misleading digital ads (39%), and even the physical theft of packages from porches (30%). More than half of adults said they received a fake shipping notice this year, while nearly four in ten encountered deceptive ads on social media.

“Criminals are relentless during the holidays, exploiting the many opportunities that come with a busy season—from shopping and traveling to charitable giving,” said Kathy Stokes, Director of Fraud Prevention Programs at the AARP Fraud Watch Network, in a Nov. 18 statement.  “Understanding how they operate is the first step toward protecting yourself and your loved ones,” she says.

Although online scams continue to rise, many consumers still prefer using debit cards—even though recouping funds taken from a victim’s bank account often takes far longer than resolving a disputed credit card charge. Still, the report shows that safer payment habits are gaining ground.

While 72% of consumers plan to use a debit card this year, credit card use is up significantly from 2024 (64%), with nearly seven in ten planning to use a credit card during the upcoming holiday season.

The survey also found that 64% of consumers who plan to purchase gift cards this season expect to buy them off the rack at retail stores, such as grocery stores or pharmacies. This continues to be a major vulnerability: 33% of U.S. adults reported giving or receiving a gift card with no balance. Fraudsters often record the card number, expose and reseal the PIN, then wait for activation before draining the funds.

Consumers are increasingly targeted through peer-to-peer (P2P) payment apps as well, with two in five users reporting that they have sent money to someone they did not know. Despite growing awareness, many people still underestimate the risks of using debit cards or fail to verify charitable organizations before donating.

New Federal Plan Aims to Protect Seniors

AARP’s survey found that 92% of respondents—across liberal, moderate, and conservative viewpoints—want Congress to do more to protect older adults from fraud. And Congress appears to be listening.

Last week, U.S. Sen. Kirsten Gillibrand (D-NY), ranking member of the Senate Aging Committee, held a Dec. 4 virtual press conference announcing the introduction of S. 3355, National Strategy for Combating Scams Act of 2025, legislation aimed at providing stronger safeguards for seniors this holiday season and beyond. This bill was referred to the Senate Judiciary Committee.  Gillibrand warned that financial scams, which cost Americans more than $16 billion last year, disproportionately harm older adults.

Throughout the event, Gillibrand underscored the economic hardship caused when older adults lose money to fraud. She noted the rapid evolution of artificial intelligence, which is enabling scammers to create more sophisticated and “hyper-realistic imposter scams” that require immediate government action.

Senate cosponsors include Sens. Rick Scott (R-FL), Mark Kelly (D-AZ), and Ashley Moody (R-FL). H.R. 6425, companion legislation is being led in the House by Reps. Gabe Amo (D-RI) and Derek Schmidt (R-KS).  Hopefully, we’ll see Rep. Seth Magaziner (D-RI) join Rep. Eleanor Homes Del Norton (D-District of Columbia) and Rep. Sarah McBride (D-DE) as cosponsors.

According to Gillibrand, more than four in ten Americans say they have lost money to scams or had their sensitive information stolen. Older adults account for an estimated 30% of financial losses, with an average loss of $83,000 per incident. Gillibrand shared the story of a 75-year-old man who received up to five scam calls each day and a senior woman who lost $39,000.

The Government Accountability Office (GAO), often referred to as Congress’s watchdog, recently identified at least 13 federal agencies conducting anti-scam efforts, each working independently under different mandates. GAO recommended that the FBI take the lead in establishing a unified National Strategy for Combating Scams. Gillibrand’s bill would give the FBI a legal obligation to implement that framework.

During the press conference, Gillibrand also addressed underreporting, noting that many victims—like her own aunt who lost $5,000 to a scammer impersonating an FBI agent—feel too embarrassed to tell family members or law enforcement. She shared the story in response to a question from Brian O’Neill, host of Newsmaker on WLEA Radio, underscoring how shame and secrecy allow scammers to continue exploiting vulnerable individuals.

“I’m proud to introduce the bipartisan National Strategy for Combating Scams Act to help make sure seniors don’t get scrooged this holiday season,” said Gillibrand. “It’s clear that we need a coordinated national strategy to tackle the increasingly sophisticated scams targeting our seniors, and this legislation would bring that to fruition. I look forward to working with colleagues on both sides of the aisle to get this vital bill across the finish line.”

Sen.Rick Scott (R-FL), chair of the U.S. Senate Special Committee on Aging, added: “Families across the country are being hammered by increasingly sophisticated scams, and Washington has been far too slow to respond. This bipartisan effort finally brings federal agencies together, cuts duplication, and creates a real national plan to protect seniors and hardworking Americans.

AARP, which represents 125 million adults age 50 and over, strongly endorses the National Strategy for Combating Scams Act of 2025. “The strategy encourages smarter use of technology, better data collection, and stronger partnerships with banks, tech companies, and law enforcement to help prevent scams and support victims. And it prioritizes making resources easier to access, providing more effective recovery for those who’ve been targeted,” says AARP’s Jennifer Jones, vice president of Financial Security & Livable Communities, Government Affairs.

House Considers Companion Anti-Scam Bill

On the House side, Rep. Amo introduces a companion measure (H.R. 6425). “Too many Rhode Islanders have been taken for a ride by scammers skimming their pockets and stealing their hard-earned money, leaving many devastated and destitute,” he said. “I’m proud to introduce the bipartisan National Strategy for Combating Scams Act to ensure we are addressing the rising scam threat in a coordinated and strategic manner.”

According to the FBI, Rhode Islanders lost $6,309,411 to senior fraud in 2024 alone. Earlier this year, Amo launched the bipartisan Stop Scams Caucus to combat financial fraud, cyber scams, and cross-border criminal networks. In Rhode Island, he also convened a roundtable discussion at the Middletown Senior Center focused on scam prevention.

The National Strategy for Combating Scams Act is endorsed by a broad coalition of national organizations, including AARP, Aspen Institute Financial Security Program, Chamber of Progress, Global Anti-Scam Alliance, Justice in Aging, the National Adult Protective Services Association (NAPSA), National Association of Social Workers, National Asian Pacific Center on Aging, National Caucus and Center on Black Aging, National Sheriffs’ Association, Stop Scams Alliance, and many others.

Medicare and Medicaid at 60: Historic Milestones, Looming Changes

As 68 million Medicare beneficiaries recognize the 60th anniversary of Medicare, changes are coming to these landmark programs. Presented as efforts to slash costs and combat fraud, the thought of change to Medicare in almost any way leaves many older Americans feeling threatened that their health and financial security will be impacted in a negative way.

A Legacy Under Threat – or Repair?

On July 30, 1965, President Lyndon B. Johnson signed H.R. 6675 into law during a ceremony at the Truman Library in Independence, Missouri. Lasting between 45 and 60 minutes, the event marked the official creation of Medicare and extended guaranteed health coverage to 16 million Americans aged 65 and older—coverage that had not previously existed.

Former President Harry Truman, who had fought for national health insurance two decades earlier, was present for the ceremony. He was enrolled as Medicare’s first beneficiary and received the first Medicare card at the event.

Speaking at the bill signing, President Johnson declared, “No longer will older Americans be denied the healing miracle of modern medicine. No longer will illness crush and destroy the savings that they have so carefully put away over a lifetime… No longer will young families see their own incomes, and their own hopes, eaten away simply because they are carrying out their deep moral obligations to their parents.” Johnson concluded, “When the final chapter of this generation is written, it will be said that we met the needs of the old, and that we did not abandon them to the despair and loneliness and hardship that comes when illness strikes the aged.”

Today, Medicare provides universal health coverage to Americans age 65 and older—though, as the National Committee to Preserve Social Security and Medicare (NCPSSM) humorously noted in its blog, “Ironically, the program is not yet old enough to qualify for itself.”

 The law created Part A to provide hospital insurance funded through payroll taxes and Part B to cover doctor visits and outpatient services on a voluntary basis. Part C, known as Medicare Advantage, offers a privatized, for-profit alternative to traditional Medicare. Part D (coverage through private, for-profit insurers rather than through the traditional Medicare program), added in 2003, provides coverage for prescription drugs. Over the years, Medicare has evolved to offer a wider range of services, yet it still falls short in some areas. Efforts to expand coverage to include essential benefits like dental, hearing, and vision have repeatedly failed to pass Congress.

Medicaid is a federal-state program that offers health coverage to low-income individuals, including children, pregnant people, and those with disabilities — in addition to covering long-term care for eligible seniors. It is a key funding source for U.S. safety net healthcare providers.

NCPSSM’s President and CEO, Max Richtman said that, “We should take a moment to marvel at the fact that — like Social Security — Medicare was created by national leaders who had a vision of a more just society, where, instead of leaving older people to get sick and die in poor houses or becoming a burden to their children, America would commit itself to providing basic health (and financial) security to our most vulnerable citizens.  Through the foresight of Franklin D. Roosevelt and Lyndon Johnson, these benefits (Medicare Part A and Social Security) would be earned through workers’ payroll contributions, giving Americans a true stake in insuring themselves against the hardships of aging.”

What’s at Stake

Despite Medicare’s broad support, it has frequently come under political attack, often rationalized by concerns over its long-term financial viability. The most recent Medicare Trustees report projects that the program’s Part A trust fund could be depleted by 2033 if Congress does not act. At this point the fund’s reserves would only be able to pay 90% of the total scheduled benefits in what there is to spend on Part A.

In 2025, following weeks of political discourse, the “Big Beautiful Bill” was signed into law on July 4, 2025. Known formally as H.R. 1, the sweeping 900-page legislation passed the House on May 22 by the razor-thin margin of 215–214–1. Every House Democrat opposed the measure. Two Republicans joined them. Freedom Caucus Chair Andy Harris of Maryland voted “present.” Two Republican members abstained.

Richtman, sharply criticized the law, saying it “rips health coverage away from as many as 16 million Americans and food assistance from millions more.” Its Richtman’s opinion to warn that 7.2 million seniors who are dually enrolled in Medicare and Medicaid, and another 6.5 million who rely on SNAP (Supplemental Nutrition Assistance Program), stand to lose vital support for health care and nutrition.

The Center for Medicare Advocacy (CMA) also raised serious concerns. CMA is a national, non-profit law organization, working to advance access to Medicare and quality health care through advocacy on behalf of older and disabled people. They warn that Medicare is being steadily privatized. More than half of all beneficiaries now receive their care through Medicare Advantage plans, which costs taxpayers approximately 20 percent more than traditional Medicare. These plans often restrict access to care through networks and pre-authorization requirements. CMA estimates that the $84 billion in overpayments to Medicare Advantage plans this year alone could instead have funded comprehensive dental, vision, and hearing coverage for every Medicare recipient.

CMA further maintains that H.R. 1 strips Medicare coverage from certain lawfully present immigrants who had earned eligibility through their work histories. Undocumented immigrants are not eligible for Medicare. It also blocks implementation of enhancements to the Medicare Savings Program that would have helped low-income beneficiaries afford care, stops new federal nursing home staffing standards estimated to have the potential to save 13,000 lives per year, and limits Medicare’s ability to negotiate lower drug prices for some of the most expensive medications.

Medicaid, enacted alongside Medicare in 1965 to serve low-income individuals and families, faces even steeper reductions under H.R. 1. The law’s new eligibility restrictions are projected to cause from 10-16 million people to lose coverage.

Medicaid Fraud, Waste, and Abuse

Medicaid fraud, like other forms of healthcare fraud, involves intentionally submitting false information to receive payment for services not rendered, unnecessary services, or inflated claims. This fraudulent activity has serious consequences, harming patients, honest providers, and taxpayers. In 2024, the national Medicaid improper payment rate was estimated at 5.09%, translating to $31.1 billion in federal Medicaid improper payments. Medicaid Fraud Control Units (MFCUs) recovered $1.4 billion in FY 2024, representing a return of $3.46 for every $1 spent. Criminal recoveries in FY 2024 were the highest in 10 years, reaching $961 million, more than double the five-year average.

In 2024, 8% of Medicaid claims were deemed improper payments due to fraudulent practices. Fraudulent billing for services not rendered or exaggerated in complexity (upcoding or ghost billing) was a common theme in 2024 fraud cases. Misuse of telehealth and the involvement of third-party billing firms were also notable trends in Medicaid fraud cases in 2024. Prescription drug scams, especially involving opioids and controlled substances, remain among the most significant Medicaid fraud cases. Medicaid fraud in managed care settings increased by 30% in the past five years.

Examples of recipient fraud include lending or sharing a Medicaid Identification card; forging or altering a prescription or fiscal order, using multiple Medicaid ID cards, re-selling items provided by the Medicaid program, and selling or trading the card or number for money, gifts or non-Medicaid services.

Examples of provider Fraud, Waste, and Abuse include billing for Medicaid services that were not provided or for unnecessary services, selling prescriptions, intentionally billing for a more expensive treatment than was provided, giving money or gifts to patients in return for agreeing to get medical care, and accepting kickbacks for patient referrals.

Rhode Island Senators React 

In response to the changes in H.R. 1, Rhode Island’s U.S. Senators Jack Reed and Sheldon Whitehouse joined the entire Senate Democratic caucus to introduce S. 2556 on July 30, the 60th anniversary of Medicare and Medicaid. This three-page bill seeks to repeal the health care cuts included in H.R. 1 and permanently extend the Affordable Care Act’s enhanced tax credits, which are set to expire at the end of 2025. Full Democratic caucus sponsorship of legislation—led in this case by Senate Minority Leader Chuck Schumer—is exceptionally rare and underscores their urgent need to call out the Big Beautiful Bill for its healthcare changes.

S 2556 has been referred to the Senate Finance Committee and at press time no House companion measure has been introduced.

Senator Reed emphasized the wide-reaching impact of H.R. 1, saying that millions of people are expected to lose health coverage under the combined effects of the bill’s Medicaid and ACA cuts. The repercussions, he said, will be felt by health clinics, hospitals, seniors, nursing homes, and patients across the country.

According to an analysis by KFF (formerly the Kaiser Family Foundation) 43,000 Rhode Islanders could lose health coverage due to the bill. Of those, 38,000 would lose insurance as a result of Medicaid cuts, and another 5,500 due to changes in the Affordable Care Act. The same analysis projected that Rhode Island would lose $3 to 5 billion in federal Medicaid funding over the next decade due to the law’s provisions.

Reed also noted that the bill includes cuts to the SNAP (food stamps) program—reducing federal funding by 20 percent through 2034. States would have the option to pick up the difference using their own funds.  In Rhode Island, where 1/3 of the population is on social welfare assistance of some kind, including Medicaid and SNAP, an estimated 144,000 Rhode Islanders are expected to lose SNAP benefits entirely. To maintain SNAP provisions in Rhode Island, the estimated cost could be as high as $51 million.

Reed explained that without ACA premium tax credits, younger workers will also face rising health insurance premiums beginning in 2026, putting additional financial strain on working families. When people lose access to health insurance, they are more likely to delay or skip care, leading to poorer health outcomes and higher overall costs. Federal law would still require hospitals to provide emergency care, meaning hospitals will absorb the financial burden when patients cannot pay. There are also new limits on how medical costs can be held against individuals, especially in Rhode Island, with provisions against destroyed credit ratings, liens, and bankruptcy moves.

BBB Supporters Say It’s a Pill We May Need

According to supporters of H.R. 1, recent changes to Medicare, Medicaid, and SNAP may be seen as fearful, but positive, because they improve affordability, access, and long-term health outcomes.  They says that H.R. 1. Medicare’s new $2,000 cap on drug costs protects seniors from crushing out‑of‑pocket expenses. Medicaid’s pilot coverage for obesity treatments like GLP‑1 drugs supports preventative care and could reduce chronic illness. Meanwhile, efforts to modernize SNAP enrollment and target benefits more effectively aim to reduce administrative waste and better serve low‑income families. However, the introduction of new SNAP work requirements, while controversial, is intended to encourage workforce or volunteer participation among beneficiaries. These reforms reflect a broader commitment to updating essential safety net programs, making them more efficient, equitable, and responsive to today’s health and economic realities—without sacrificing core benefits, supporters add.

A New Reality

As aging advocates and policymakers mark the 60th anniversaries of Medicare and Medicaid, they are forced to address a new reality in both programs. Rather than continually expanding to meet growing needs of older adults, these programs now face reductions that could lead to challenges in access, lower quality care, increased paperwork, disruption in treatment, higher premiums, and fewer covered services. Provider reimbursements are also expected to be cut, which may further limit access to care.

Instead of being a milestone for celebration, the 60th anniversary of Medicare and Medicaid has become a turning point for aging advocate groups—marking not progress, but threat for millions of older Americans who depend on these essential programs to live with dignity, independence, and health.

Older adults attract scammers with popularity of cyberdating

Digital technology is not just a way to find information and news, shop, or even search and apply for jobs.  For older single adults, getting back into the dating scene can be difficult. It could be after a divorce, or death of a spouse, or just deciding some years too late that having a mate is something desirable at this time of your life.

Dating rules have changed since years ago. But, since the mid-1990s, when Match.com, the world’s first online dating website was launched, millions have utilized internet dating as a way to meet potential partners without leaving their home.

Today, online dating, sometimes referred to as cyber-dating, has replaced traditional ways (like belonging to civic groups, clubs and attending church) singles use to find that special person.

Even though many might consider on-line dating a crap shoot in finding that perfect person to spend the rest of your life with, a growing number of older adults are using online dating platforms.  And many, unfortunately, are falling for online dating scams, as well.

A Snapshot of Older Online Daters

Last July, an article penned by Olivia Sidoti, research assistant, and Michelle Favero, research associate at Pew Research Center, provided an analysis of how older adults experience dating sites and apps and their views of online dating.

The data, obtained from a survey conducted in July of 2022,  was taken from a 74-page report, “From Looking for Love to Swiping the Field: Online Dating in the U.S., released on Feb. 2, 2023.

According to the Pew study, about a quarter of older Americans in their 50s have used an online dating site, compared to 14% percent in their 60s and 12% in their 70s and older.

However, just 3% of the older respondents are currently using online dating platforms or have used them with the last year, compared with 15% of those under age 50.

The Pew study found that 6% of the respondents over age 50 who were married, living with a partner or in a committed relationship, found their significant other online.

With so many dating sites and apps available to choose from, the survey findings indicate that about 1 in 5 online daters have used Tinder.

About half of the adults age 50 and over cite seeking a long-term partner or spouse as the reason they have online dated in the past year. Meanwhile, about 36% say they want to date casually, with 22% saying their motivation is casual sex.

The researchers found that women aged 50 and over are more likely than males who use a dating site or app to say their dating experiences have been negative.

About half of the online daters ages 50 and over say they have encountered someone who they thought was trying to scam them.  Furthermore, about four-in-ten online daters ages 50 and older (45%) report unwanted behaviors while seeking a date online. Specifically, they were sent sexually explicit content they didn’t ask for (33%), and 26% were continually contacted after they expressed disinterest. Seventeen percent of the older users report they were called offensive names, and 4% were physically threatened.

Protecting Yourself When Online Dating           

According to the Centers for Disease Control and Prevention (CDC), nearly one in four individuals older than age 65 are considered socially isolated. Older adults are at risk of isolation and loneliness due to living alone, loss of family and friends, chronic illness and hearing loss.  

CDC says that there are also physical health risks as well. Those dangers include significantly increased chances of an early death, 50% increased risk of dementia, 29% increase in the likelihood of developing heart disease and a 32% higher chance of having a stroke.  

There’s a Class for that!

With so many older adults not having meaningful relationships with their family or without having a significant partner, Sun City, Arizona-based Banner Olive Branch Senior Center offered a class covering the basics of finding love and companionship online.    

“We feel this is an important topic to address because there are many seniors [in our community] who are alone,” says Jackie Cromer of Banner Olive Branch and instructor of the online dating class held last April. “It’s an approach to add some fun and excitement into their lives and allow seniors to feel connected and potentially even find love,”  she said.

The class covered which dating sites to select, how to write and choose photos for your dating profile, the best ways to find and connect with potential matches, how to handle rejection, and emphasized safety tips such as not giving personal information, meeting in a public place, transporting yourself to the date and letting loved ones know your whereabouts. 

Tips on Protecting Yourself Against Romance Scams

As a growing number of older adults go online to search for that special person, scammers take advantage of these individuals. According to the Federal Trade Commission (FTC), in 2022 almost 70,000 people reported being a victim of a romance scam.

Be aware of “red flag” indicators of a potential romance scam, when approached on a dating site, warns Home Security Investigations (HSI), the principal investigative arm of the U.S. Department of Homeland Security, noting that scammers seek to gain the victim’s trust and then provide false information or misrepresentation to gain a financial benefit.

Here is some advice from Home Security Investigations (HSI):

HSI urges older online daters to watch out for the following indicators of a potential romance scam, when a potential partner:  

·         Claims they live, work or are traveling abroad.

o    Lacks proper grammar, although they claim to speak English.

·         Claims to be notably younger than you.

·         Quickly professes love to you.

·         Has a story that is inconsistent.

·         Has a minimal online presence.

·         Sends general photos (mostly fake/AI generated) of themselves traveling, shopping, or dining at luxurious locations.

o    Sends or requests explicit photos or videos.

·         Mentions the idea of meeting and being together soon.

·         Provides periodic excuses for being unable to make a video call (e.g., Facetime).

o    If a video call happens, you’re unable to see their face clearly.

·         Requests to have conversations/texts be moved to a separate app (e.g., WhatsApp, Telegram).
Asks for money, often via non-traditional methods such as cryptocurrency or gift cards.

o    Asks if you’ve ever invested in cryptocurrency and/or foreign exchange market.

o  Sends a business link of a cryptocurrency and/or foreign exchange trading platform.

o    Is combative with you or tries to divert your attention when you question their intentions.

Lastly, if your bank contacts you to express concern you are being victimized, this is perhaps the most significant red flag that you are being targeted.

Matchmaker, Matchmaker, make me a match!

Many are now saying that the most successful way to find that appropriate partner is to be introduced to her/him by someone you know – be that family or friend. And, while not plentiful, and sometimes expensive, matchmaking services that match you up for a date, one on one, are around, even in Rhode Island. The good part is they will coach you on what to where, what to talk about if it’s been awhile since you had a date-convo, and if after the date, it doesn’t work out, they will handle the uncomfortableness of that conversation with the other party – and keep working on your behalf. Some matchmaking services advertise on local radio, and that may be a good place to start. All the rules of scams and checking out the company or person are still advisable, of course – ask for references!
